Rental Terms

Scope of Application

These rental conditions apply to all contracts for the rental of cloth diapers and accessories (hereinafter referred to as "rental items") between Judes Cloth Diapers (hereinafter referred to as "provider") and the customer (hereinafter referred to as "tenant").

Conclusion of Contract
The contract is concluded when the tenant places the rental items in the shopping cart and completes the ordering process.

Rental Period and Termination

3.1 The minimum rental period for regular rental sets is 3 months. The trial set is exempt from the minimum rental period. Following the minimum rental period, the contract can be terminated on a monthly basis.

3.2 The termination must be made in writing by email or post.

Rental Prices and Payment Terms

4.1 The rental prices include statutory value-added tax.

4.2 Payment is made monthly in advance by direct debit, credit card, or PayPal.

4.3 In the event of payment delays, the provider is entitled to terminate the contract without notice and to reclaim the rental items.

Automatic Renewal

The rental contract is automatically extended by another month if it is not terminated within the notice period according to item 3.2.

Return of the Rental Items

6.1 After the termination of the rental contract, the tenant must return the rental items immediately, but no later than within 14 days.

6.2 The provider supplies the tenant with a free return label.

6.3 The tenant must ensure that the following conditions are met before the goods are returned:

  • The diapers and accessories are washed and ironed.
  • The Velcro is cleaned. Lint and hair have been removed from the Velcro.
  • Stool stains must be removed. It is completely natural for stool stains to occur. This is simply due to the fact that your baby's breast milk stool contains strong dyes. However, these are easy to remove, for example, by using oxygen bleach or exposure to sunlight.

Goods with dirty Velcro, stains, or discolorations cannot be accepted for return.

Right of Withdrawal

7.1 The tenant has the right to withdraw from this contract within 14 days without giving any reason.

7.2 The withdrawal period is 14 days from the day of the conclusion of the contract.

7.3 To exercise the right of withdrawal, the tenant must inform the provider via a clear declaration (e.g., a letter sent by post, fax, or email) about their decision to withdraw from this contract.

Consumer Rights and Information Obligations

8.1 The provider undertakes to inform the tenant about all relevant information in connection with the rental items, their availability, and additional costs (e.g., shipping costs).

8.2 The provider ensures that the rental items comply with legal requirements and the state of the art.

Liability and Compensation

9.1 The tenant is liable for damages caused by improper handling or loss of the rental items.

9.2 The provider is not liable for damages resulting from improper use of the rental items by the tenant.

Data Protection

The provider is committed to processing and protecting the tenant's personal data in accordance with the applicable data protection laws. Further information on the processing of personal data can be found in our privacy policy.

Final Provisions

11.1 Should individual provisions of these rental conditions be or become wholly or partly invalid, the effectiveness of the remaining provisions shall not be affected.

11.2 The law of the Federal Republic of Germany shall apply. The provisions of the United Nations Convention on Contracts for the International Sale of Goods shall not apply.

11.3 Exclusive jurisdiction for all disputes arising from or in connection with this contract shall be the seat of the provider, provided the tenant is a merchant, a legal entity under public law, or a special fund under public law.

Changes to the Rental Conditions

12.1 The provider reserves the right to change these rental conditions at any time to adapt them to changed legal or technical requirements.

12.2 Changes to the rental conditions will be communicated to the tenant in writing (e.g., by email). The changes are considered approved if the tenant does not object within four weeks of receiving the notification. The provider will inform the tenant in the notification of the right to object and the significance of the four-week period.
